HOUSTON (KIAH)— Three Harris County detention officers have been indicted by a grand jury for beating an inmate so badly that he was put into a coma, a lawyer said.
John Ziesemer, Ezihuo Osiminibeke, and Jimmy Poole were charged with assault causing bodily injury for their role in the injures sustained in an incident that happened in the Harris County Jail to Adael Gonzalez Garcia in November of 2022, civil rights attorney Randall L. Kallinen said on Thursday.
Kallinen claims that Gonzalez Garcia, 48, was beaten into a coma and had his skull severely fractured. Garcia was in a coma for a month and lost a large part of his skull, Kallinen said.
“The guards almost killed Adael and the Harris County Sheriff’s Office has a policy of not doing (internal affairs) investigations if a criminal case is pending against the complainant,” Kallinen said.
On Friday afternoon, the Harris County Sheriff’s Office said that the three officers were indicted and relieved of duty on May 4 and 6, pending the end of an internal affairs investigation. Consistent with their protocol, administrative action was immediately taken after the grand jury process, HCSO said.
“HCSO officers are entrusted to provide care and a safe environment for those in our custody. We take these matters seriously and conduct an internal review of all use of force incidents,” the HCSO statement said.
Our news partners report that Gonzalez Garcia was arrested on Nov. 23, 2022, on an outstanding DWI warrant from Walker County. That charge was later dropped.
The night after his arrest, HCSO reported that Gonzalez Garcia fell from his bunk bed in his cell and suffered injuries to his face. Then on Nov. 25, HCSO reported that Gonzalez Garcia got into a fight with a detention officer near the medical clinic and fell to the ground, hitting his head.
Kallinen, Gonzalez Garcia and his family held a press conference on Friday to discuss the charges and ask for reform at the Harris County Jail, which had over 27 deaths of inmates while in custody in 2022. They also want video of the incident to be released.
“Harris County does not indemnify the jail guards for civil rights violations so many injured inmates go into severe debt and never recover financially while families of those who died do not even receive funeral costs,” Kallinen said.
